These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and ClickedSys ("we", "us", "our") governing your access to and use of the ClickedSys platform, including the dashboard at app.clickedsys.com, the API server at server.clickedsys.com, and all related services (collectively, the "Service").
By registering for an account, clicking "Get started", or otherwise accessing the Service, you confirm that you are at least 16 years old and have the legal capacity to enter into this agreement. If you are acting on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
ClickedSys provides a platform for creating embeddable CTA (Call-to-Action) widgets and tracking their performance analytics (clicks, impressions, hover events) across websites operated by the User. The Service is provided on an "as is" and "as available" basis.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will endeavour to provide 14 days' notice for significant changes.
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at help@clickedsys.com if you believe your account has been compromised.
You may not share your account with others or create accounts on behalf of third parties without their explicit consent. Each account may only be registered to one individual or legal entity.
You agree to use ClickedSys only for lawful purposes and in accordance with these Terms. You represent that:

We reserve the right to suspend or terminate accounts in violation of this section without notice.
All rights, title, and interest in the ClickedSys platform — including the tracker script, dashboard, API, brand marks, and documentation — remain exclusively with ClickedSys. Nothing in these Terms grants you ownership of any ClickedSys intellectual property.
You retain ownership of all content you create or upload (CTA text, images, URLs). You grant ClickedSys a limited, non-exclusive licence to store and process this content solely to provide the Service.
Paid plans are billed on a monthly recurring basis. Your subscription renews automatically unless you cancel before the next billing date. Prices are displayed at checkout and in your account settings.
We reserve the right to change pricing with 30 days' advance notice. Continued use after the effective date of a price change constitutes acceptance of the new pricing.
Refunds are governed by our Refund Policy.
You may cancel your account at any time from your account settings. Upon cancellation, your plan will remain active until the end of the current billing period, after which your data will be retained for 30 days before permanent deletion.
We may suspend or terminate your account immediately if we believe, in our sole discretion, that you have materially breached these Terms. We will endeavour to notify you of the reason unless prohibited by law.
To the maximum extent permitted by applicable law, ClickedSys is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities.
To the maximum extent permitted by law, ClickedSys and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
In no event shall our total aggregate liability to you exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim or (b) USD $100.
You agree to indemnify, defend, and hold harmless ClickedSys and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party rights; or (d) any content you embed or transmit via CTAs.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClickedSys is registered, without regard to conflict-of-law principles. Any disputes shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction.
Before initiating formal proceedings, you agree to contact us at help@clickedsys.com to attempt to resolve the dispute informally for at least 30 days.
We may update these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
